According to Supreme Court Rule 22.1, the Clerk is demanded to "transmit it promptly" to the Justice it is addressed to. Please recall that on Nov. 3rd, Leo Donofrio originally submitted this same emergency stay application to the US Supreme Court. Despite the stay clerk - Mr. Danny Bickell - having assured Leo Donofrio that the application would be given to the Honorable Associate Justice David Souter that night, it was not transmitted promptly. In fact, it was not transmitted at all after Mr. Bickell, having made an illegal and improper substantive judgment of law, thereby denied the application on his own volition.
The emergency stay application was eventually submitted to the Honorable Associate Justice David Souter, four days late, on November 6, after Mr. Bickell was forced to concede that his denial had been improper.
The emergency stay application, having been brought to the US Supreme Court from a denial of the New Jersey Supreme Court, was required by Supreme Court Rule 22.3 to be submitted to Justice Souter as he is the Justice assigned to the Third Circuit which includes New Jersey. The application was denied by Justice Souter on Nov. 6, and such denial therefore triggered Leo Donofrio's legal right, under Rule 22.4 to renew the emergency stay application to "any other Justice." Mr. Donofrio has chosen to renew the application to the Honorable Associate Justice Clarence Thomas.
Hopefully, this time, the emergency stay application will be promptly transmitted to the Honorable Associate Justice Clarence Thomas.

So I have to ask the question - why has Obama chosen not to produce his birth certificate if he was in fact born in Hawaii? Why would it take a court order for him to do that? It doesn't make sense.
The only thing that not producing a bona fide birth certificate has accomplished is to stir up a lot of doubt about his eligibility and credibility. The statement referred to above does not exist in those transcripts. In fact, in my reading of those transcripts no comment regarding Obama's citizenhsip status was ever made by Keyes or anyone else involved.

Up until this time, it has been assumed that every candidate and POTUS has met Article II qualifications. We assume that in fact no one would dare to run for and claim the Presidency if he/she didn't meet the qualifications of the Constitution. Looks like our age of innocence is over.
It appears that we will have to craft legislation to assure eligibility criteria are met for the POTUS, and to assign appropriate responsibilities to assure so.. If the country wants to amend the Constitution to allow naturalized or dual citizens to serve as POTUS, then we have that mechanism, which ¾ of the states have to ratify. None of this can happen before the January 20th inauguration.
The four questions to the Supreme Court also remind me of other areas in which we voters do not have redress when something goes wrong. Although I am now an "unaffiliated" voter, having left the democratic party after November 4th, it also appears that democrats do not have an avenue of redress when the DNC and RBC violate party rules as they did in this case to deny Hillary Clinton the nomination. In addition, we now know that caucuses can be gamed, and do not serve the interests of democracy nor do they provide a fair representation of the strength of our party's candidates. Because of the DNC, RBC and Obama's gaming of the system with caucus fraud, and the blatant use of race and misogyny to silence critics, we are witnessing the democrats begin the disintegration of the "democratic brand". I am sure there are issues in the Republican party after GWB destroyed the "republican brand". We all need a detox from our respective koolaid brands in order to really see clearly.
What is next for our country? Well, if we don't want to dive into that hot pool, and we're not going to run away, then we'd better start creating an alternative vision. A line in one of my favorite movies, The Shawshank Redemption, sums it up for me:

There's a HUGE caveat that isn't addressed in that article: Naturalized citizens have divided loyalties, yes, but not Natural Born citizens with dual-citizenships from birth. This is purely for one reason.

A child, at birth, has no choice in this matter. If he has no choice, then he has no power/rights to amend that situation. By allowing his Kenyan/UK citizenship to expire, he has shown that it was his adult decision to only show his allegiance to the USA and therefore has never had a conflict of allegiance when he has been in a position to have views on the matter.
If we were to take Leo's argument at full value, almost all of us would lose our "Natural Born" status as at some point our ancestors came here, as so many of them well after the DOI and Constitution, with different citizenships in question. Their children would have had citizenship eligibility in other countries and so would not be "Natural Born" and down the line you could argue it would go.

Interesting fact about Rahm Emmanuel I just learned while watching a Charlie Rose interview from June, where he and his two brothers discussed their family, health care reform and more.
The fact that I learned is the most important lesson Rahm learned from growing up in his family is "immigrant culture". As it turns out, Rahm's mother is an American Citizen from birth and, you guessed it, his father was Israeli born, and later became a citizen of the United States after immigrating in 1959.
I am not pointing this out to imply some sinister disposition, but it does help explain the bond and level of trust between Obama and Rahm Emmanuel. And it would also help explain why Obama felt it was vital to have Emmanuel as Chief of Staff out of the shoot.

Off point AND untrue. The Kenya Constitution as a provision in Section 97 (if I recall correctly) called "subsection (7)" relating to dual citizenship which allows one who would normally have the said dual citizenship cancelled to defer that cancellation until a date of his choosing so that if Obama decided (never having rejected Kenyan citizenship) that he didn't wish to give up his Kenya citizenship until, say, 2078 he would still have the dual citizenship.
There is further evidence of Obamas attachment to his African "homeland" since he traveled to Kenya in 2006 (on U. S. Taxp[ayer money) as a Senate (ahem) "factfinder" where he proceeded to openly campaign for a man who lost the then-upcoming Kenyan election, Raila Odinga (who lost the election but then reportedly fomented violence and rioting among Muslins that left a thousand or more dead, several hundred Christian churches burned - including one with dozens of women and children inside thereby burning them to death).
To quell the violence the democratically elected (Odinga's opponent) signed a power-sharing Memorandum Of Understanding with Odinga to allow Odinga to have equal political power wpuld he but "call off" the Muslim rioting and violence.
Also, there is evidence that "friends of Senator BHO" caused about $800,000 to Odinga's efforts and Obama was in contact with him by telephone as recently as January 2008 during the New Hampshire primary. Pe3rhaps planning how they would foment similar violence and unrest in the US of A???

I propose that we all come to a consensus as to which three-four newspapers and/or Networks to mail and/or email each day demanding that they begin following and reporting this story.
BUT, EVEN BETTER: is if we all agreed to write an Editorial, based on the information that Mr. Donofrio has provided us with, and in our own words, to each of the following newspapers. A newspapers editorial board regards Editorials as a barometer of under-reported stories. If they begin getting an influx of Edirotial submissions from all over the country on a particular subject, and they are all CONSISTENT in the information they present, then there is a chance that one of them will eventually pick up the story.
I propose the New York Times (always have to include them as a barometer), the Wall Street Journal, the Washington Times and the New York Post to start. The NY Times, though Editorially liberal is a great newspaper for breaking hard news. The other three papers have a reputation for being right-leaning. If one of those papers pick up Mr. Donofrio's case as a story, then other news organizations will soon follow suit.
I wonder if contacting the news media sources that are running the Keyes story might be an effective way of getting Mr. Donofrio's lawsuit info published. So far I've seen the Keyes story in a Sacremento paper, the NBC station previously mentioned, and now the "Orange County Register."
I emailed the info to a local station in my area. Although getting the story into a major paper would be great, it's doubtful it would happen. I'm sure they already know about it and are choosing to ignore it, and they have a track record of ignoring the public. So perhaps working on smaller papers and news stations might be more effective.
